Control de constitucionalidad y tiranía de la mayoría: un análisis crítico de la protección judicial de las minorías en los Estados democráticos
Un sector influyente de la teoría constitucional ha sostenido tradicionalmente que el control judicial de la ley es legítimo porque protege los derechos de las minorías y grupos marginados contra las decisiones defectuosas o malintencionadas de las mayorías. En este artículo sostengo que en realidad la capacidad de los jueces para proteger a las minorías solo puede justificar el control judicial de la ley cuando se cumplen supuestos normativos y fácticos específicos.
