Los caminos compartidos en la historia del derecho de autor y el depósito legal en el Reino Unido
Este artículo trata sobre la relación histórica entre el derecho de autor y el depósito legal en el Reino Unido. La introducción presenta los orígenes del depósito legal en Inglaterra como una medida voluntaria que surgió de un acuerdo entre la Compañía de Impresores y Thomas Bodley. Luego se examina la larga unión legislativa (1709-2003) de dichas figuras jurídicas (derecho de autor y depósito legal) en el Reino Unido, con especial énfasis en el periodo de 1805 a 1836, cuando se presenta la llamada “batalla de los libros”, un agudo debate político, legislativo y judicial entre los editores y las bibliotecas depositarias. Then, I analyse the long legislative union (1709-2003) of copyright and legal deposit in the United Kingdom, with special emphasis on the “battle of the books” (1805-1836); a political, legislative and judicial debate between publishers and the copyright libraries. The Legal Deposit Act of 2003 extended the scope of this heritage measure to digital content including web material. Finally, the conclusions highlight the important role of State intervention to design cultural policies that take into account the public interest related to cultural heritage and the economic concerns of copyright holders.
